The practice of Personal Injury law primarily involves representing individuals who have been injured as a direct result of the fault (negligence) of others in any type of accident including but not limited to the following:
- Auto accidents (the most common type);
- Collisions involving pedestrians;
- Collisions involving bicyclist;
- Motorcycle accidents;
- Slip and fall accidents;
- Premises liability accidents;
- Boat and jet ski/wave runner accidents;
- Trucking accidents;
- Injuries caused by defective products;
- Food poisoning;
- Injuries at amusement parks;
- Cruise ship accidents;
- Aviation accidents;
- Injuries resulting from negligent security;
- Injuries resulting from medical negligence (medical malpractice cases);
- Nursing home neglect;
and accidents resulting in wrongful death.
Because not all injuries result in a viable personal injury case, we must be able to prove the following in order to recover for the damages sustained by the client:
- The defendant owed a duty to the client
- The defendant breach that duty;
- The breach of that duty caused the client to be injured;
- And the client suffered damages as result of the breach of duty by the defendant.
The amount of monies recoverable will generally depend on the severity and permanency of the client’s injuries, the accompanying pain and suffering, the extent of fault on the part of the defendant along with the amount of liability insurance available or the defendant’s financial viability in the event of a self-insured or underinsured defendants.
Damages which may be recoverable include out of pocket medical bills (past and future), loss wages and loss of earning capacity, pain and suffering and emotional distress.
Personal injury cases are generally taken on a contingency fee basis so that the client pays no fees or costs unless there is a recovery from the at fault party or their insurance carrier either through settlement, judgment, or jury verdict. In the event of a recovery, we typically charge 1/3 of the proceeds recovered if the case is settled without the filing of a lawsuit and 40% of the proceeds recovered if the case proceeds to court. The client pays nothing if there is no recovery and client pays costs only in the event of a recovery.
